Fred and Jeremy will discuss:

• the conflicting positions of the New Zealand and Australian courts and the wash up of their decisions on when a statutory charge applies to deny an insured access to defence costs
• he Australian insurance industry's response to ensuring insured parties under policies with costs inclusive limits are guaranteed access to defence costs
• whether the statutory charge provisions of the relevant New Zealand statute has extra-territorial operation where, for example, an Australian based insured defending an Australian suit holds a policy governed by New Zealand law
