On 2 December 2009 the High Court of Australia dismissed the appeal of Zurich Australian Insurance Ltd and thereby resolved the longstanding issues that have been argued in the appellant courts of Western Australia for 10 years. The decision dealt with various issues including the Insurance Contract Act 1984 (Cth), double insurance and subrogation. Sean Popperwell was the instructing solicitor for Speno Rail Maintenance Australia Pty Ltd and will provide an analysis of the history of the litigation and the decisions of the Courts at the various levels.
