In the second of our 2016 ‘Basics & Beyond’ series, Michael Thompson QC of the Victorian Bar and George Karalis of Willis Towers Watson will discuss the practical effects of section 45 of the Insurance Contracts Act 1984 on double insurance claims. This presentation will consider the law of double insurance and, in particular, practical examples and potential risks which arise when a policy attempts to limit or exclude the liability of the insurer by reason of the insured entering into some other contract of insurance.
Commonly, for example, construction contracts will require contractors and subcontractors to procure their own contracts of insurance which name the principal as an insured. However, what happens when, for example, a principal then also claims under its own insurance policy? Michael and George will outline the key issues to be aware of when a claim is made in these circumstances and the potential risks if a policy does not respond.
This seminar will be of special interest to:
- insurance claims managers, brokers and loss adjusters;
- principals, contractors and subcontractors to construction contracts;
- legal practitioners.
