EVENT: Watch out! Tips & Traps for Obtaining, Using & Protecting Surveillance |
Description
Since the introduction of the Personal Injuries Proceedings Act 2002 there has been much uncertainty with respect to how the disclosure provisions within that Act affect surveillance footage and reports. Despite this, there has been minimal judicial consideration or guidance on the issue. Jessica and Rod will cover the vexed question of surveillance in insurance litigation - when is it useful? They will consider and discuss issues including:
- Disclosure implications once surveillance has been obtained;
- Making application to relieve a party from the obligation to disclose surveillance;
- How to avoid alerting the other party to surveillance;
- How to make the most of surveillance at trial;
- How to use social media when investigating allegations; and
- Implications for new technology.
