Mann’s Annotated Insurance Contracts Act 6th edition provides the full text of the Insurance Contracts Act 1984 accompanied by clear and concise annotations written by Peter Mann and Candace Lewis.

Significant legislative reform to the Insurance Contracts Act 1984 has occurred with the long-awaited developments delivered by the Insurance Contracts Amendment Act 2013. The significant amendments have resulted in changes to the following areas: the duty of utmost good faith, electronic communication, ASIC powers, disclosures and misrepresentations, remedies under contracts of life insurance, the rights of third party beneficiaries and subrogation. The amending Act received assent on June 28, 2013. The new edition includes pre-amendment and future versions of the legislation where appropriate.

Case law developments since the last edition are reflected in updated annotations and include Maxwell v Highway Hauliers and Prepaid Services v Atradius.

The new edition of Sutton's Insurance Law in Australia returns to the Thomson Reuters insurance practitioners’ library after 15 years. The 4th edition builds on the authority and reputation of earlier editions while covering the sweeping developments in legislation, regulation and case law since the last edition was published in 1999. As with previous editions, the text contains discussion of the most important English and Australian cases, emphasising that the Insurance Contracts Act 1984 (Cth) is far from a comprehensive code and many issues of principle as well as interpretation remain firmly within the province of the common law.

The partnership of Professor Robert Merkin and Ian Enright, under Michael Kirby’s consulting editorship, gives authoritative structure and detail to this account of modern Australian insurance law. The background and credentials of the authors infuse the work with insights into Australian issues through contrasting and comparing Australian and English law. The ordered structure reflects issues that arise in modern insurance contracts, integrating legislation, regulation and case law around current commercial issues.
