Description
There is a significant lack of consistency in relation to how the principles underpinning proportionate liability are given effect in the cognate legislation of the various Australian jurisdictions. Some of the differences create the potential for undesirable and uncertain application of the principles and the capacity for contracting parties to engage in forum shopping. Justice Nicholson will provide a practical perspective on some of the more vexing issues bearing on proportionate liability in Australia, including the question of how a claim is to be determined as apportionable, issues arising with respect to contracting out and the central but problematic concept of who is a concurrent wrongdoer, particularly in light of the recent High Court decision in Hunt & Hunt v Mitchell Morgan Nominees Pty Ltd.

About The Honourable Justice Kevin Nicholson:
Justice Nicholson has held academic appointments at the University of Newcastle and at the University of Adelaide where as an Associate Professor he lectured in the areas of insurance, contract, business regulation and professional liability. He has contributed to publications including Halsbury’s Laws of Australia, the Insurance Law Journal, the Australian Law Journal, the International and Comparative Law Quarterly and as co-author of Law for the Medical Profession. Before joining the South Australian Bar in 1997 His Honour practiced law in both New South Wales and South Australia. He was appointed Queens Counsel in 2006, appointed to the District Court of South Australia in 2006, the Supreme Court of South Australia in 2012 and elected a Fellow of the Australian Academy of Law in 2013
