EVENT: Metadata: 'The Insurance Dimension' |
Summary |
Recent Australian and International cases demonstrate that digital evidence, including its metadata, continue to present challenges to courts in both the pre-trial and trial stages. Developments in information and communications technologies, principally relating to digital evidence and metadata, the miniaturisation of technologies and the impact of cloud computing, are the key drivers of change. Each present challenges for Australian society, governments and corporations (including insurers) and for effective, cost efficient, litigation processes. In addition, the 'Internet of Things' is estimated to be in the many billions of devices, together with its metadata.
This presentation will seek to address these challenges by reference to recent judicial and legislative developments and case studies and will illustrate the critical, practical insurance law dimensions of metadata for the insurance industry and lawyers. |

Nigel was the Chair of the International Workshop of e-Forensics Law for the e-Forensics 2009 Conference and in 2010 was a joint author of a report to the Commonwealth of Australia's Department of Broadband, Communications & the Digital Economy regarding the privacy, security and identity management implications of cloud computing. Since 2009 Nigel has also been the Course Coordinator of both the Insurance Law and the Technology, Law & Society subjects ini the Master of Laws programme at the University of Adelaide Law School.
