The focus of this session will be the decision of the NSW Supreme Court in Johnston v Endeavour Energy . This decision illuminates a range of interesting and challenging issues relating to large loss subrogated recoveries and the use of class actions by insurers to pursue subrogated recoveries.

About Susanna Khouri
Susanna is a former lawyer with more than 18 years commercial litigation experience in private legal practice principally with DLA Phillips Fox (now DLA Piper Australia) in Sydney.  

Susanna joined listed litigation funder, IMF Bentham Limited, in June 2008 as an Investment Manager.  

Her large projects at IMF have included:
•    proceedings against the Commonwealth of Australia and other parties to recover losses caused by regulatory action against Pan Pharmaceuticals Ltd;
•    claims by unitholders in the Premium Income Fund against KPMG as compliance plan auditor of the Fund; and
•    claims by councils, churches and charities against Lehman Brothers Australia Limited (in liq) and ratings agency, Standard & Poor’s, in connection with toxic financial products.
