EVENT: Whaddya Mean, I Can't Sue My Lawyer? (Advocates Immunity)

Description

In 2005 the High Court entrenched Australian lawyers’ enjoyment of immunity from liability for negligence in the conduct of a case in court, including preparing for a trial.
‘Advocates immunity’ protects barristers and litigation lawyers from being sued for bad or wrong decisions they have made which have an ‘intimate connection’ with ‘in-court work’.  The rationale behind advocates immunity is the protection of the finality and certainty of judicial determinations.
The recent High Court’s decision in Attwells & Anor v Jackson Lalic Lawyers Pty Ltd [2016] limits the scope of the advocate’s immunity by emphasising its rationale to identify the ‘intimate connection’ required between a lawyer’s work and the conduct of a case in court to attract its operation.

Join Grant Feary and Enzo Belperio for an analysis of the High Court’s decision in Attwells and further commentary from the High Court on solicitor negligence, including a discussion on the principle and extent of advocates immunity, its ramifications for the interrelationship between clients, solicitors and barristers, and how it might play out in the insurance litigation arena.

Grant Feary is the Deputy Director of Law Claims.  Prior to joining Law Claims in 2014 Grant had over 25 years’ experience in many difference aspects of commercial litigation practising in firms of various sizes.  He has acted in a number of matters involving claims against professionals across the spectrum of professions.  Since 2014 Grant has worked at Law Claims which is the unit of the Law Society responsible for the management of the compulsory professional indemnity insurance for the legal profession in South Australia.  

Enzo Belperio is a barrister at Bar Chambers, specialising in commercial and civil litigation.  He is on the Bulletin Editorial Committee of the Law Society of SA, is a Senior Reporter for the South Australian State Reports, and published articles last year in the Australian Insolvency Journal and Australian Resources and Energy Law Journal.
