The focus of this session will be the decision of the NSW Supreme Court in Johnston v Endeavour Energy. The decision illuminates a range of interesting and challenging issues arising from the use of class actions to pursue subrogated recoveries. This session will cover:

1. The legal framework for subrogated recoveries.

2. The class action framework.

3. Funding for class actions to pursue subrogated recoveries.
